These Terms and Conditions ("Terms") govern your access to and use of the Color Formula Vault mobile application (the "App"), operated by Color Formula Vault ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years old and capable of forming a binding contract to use the App. By using the App, you represent that you meet these requirements. The App is intended for use by licensed or practicing hair styling professionals in connection with their professional work.
To use the App, you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding your account password and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Color Formula Vault allows hairstylists to record, organize, and retrieve hair color formulas, client notes, and related photos, and provides a calculator tool to help scale formula quantities. The App is a record-keeping and organizational tool only.
The App is a tool to help you store and recall your own professional formulas and notes. It does not provide cosmetology advice, and any formulas, ratios, processing times, or calculations displayed in the App are based solely on the information you personally entered.
• You are solely responsible for verifying the accuracy of any formula, ratio, or processing time before applying any product to a client.
• You are solely responsible for client allergy testing, patch testing, product safety, and compliance with manufacturer instructions and applicable cosmetology regulations.
• Color Formula Vault is not a substitute for your professional judgment, training, or licensing requirements, and we are not responsible for any outcome resulting from services you perform using information stored in the App.
You may use the App to store information about your clients, including formulas, notes, and photographs. You represent and warrant that you have the necessary rights, consents, and authority to collect, store, and use this information, including any consents required under applicable law for photographs or personal information of your clients. You are solely responsible for your own compliance with applicable privacy and data protection laws regarding your clients' information.
We may offer a free trial or free access period for new users, the length and terms of which will be presented to you at signup.
After any free period ends, continued use of certain features may require a paid subscription, billed on a recurring basis (monthly or annually) at the rate displayed to you at the time of purchase. By subscribing, you authorize us (or our payment processor) to charge your chosen payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through your account settings or the applicable app store. Cancellation will take effect at the end of your current billing period, and you will retain access until that time. Except where required by law, payments are non-refundable.
We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price increase before it applies to your subscription.
You agree not to:
• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Upload or store content that infringes the intellectual property or privacy rights of any third party.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
• Use the App to harass, abuse, or harm another person.
• Upload viruses, malware, or other harmful code.
The App, including its design, features, branding, and underlying code, is owned by Color Formula Vault and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your own professional purposes, subject to these Terms. You retain ownership of the client data, formulas, notes, and photos you enter into the App ("Your Content"). By submitting Your Content, you grant us a limited license to host, store, and display Your Content solely for the purpose of providing the App's services to you.
You may stop using the App and delete your account at any time through the App's Profile screen. We may suspend or terminate your access to the App if you violate these Terms, engage in fraudulent or harmful activity, or for any other reason at our discretion, with or without notice. Upon termination, your right to use the App will cease, and we may delete your account data in accordance with our Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA STORED IN THE APP WILL NOT BE LOST OR CORRUPTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, COLOR FORMULA VAULT AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Color Formula Vault and its owners, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party, including any claims related to client data or services you perform.
We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
